2. Scope
These general terms and conditions apply to all quotes, agreements and services provided by Artisu Interieur to its clients (consumers). Deviations from these terms are only valid if agreed expressly and in writing in advance.
3. Quotes and formation of the agreement
3.1 A first, no-obligation intake meeting does not commit the client to anything.
3.2 Quotes from Artisu Interieur are valid for 30 days, unless stated otherwise.
3.3 The agreement is formed as soon as the client approves the quote in writing (by email or signature) and, where applicable, has paid the agreed deposit.
4. Prices and payment
4.1 All prices on the website and in quotes to consumers include VAT, unless expressly stated otherwise.
4.2 Invoices must be paid within 14 days of the invoice date, unless another term has been agreed in writing.
4.3 If payment is not made by the due date, the consumer first receives a free written reminder with a period of at least 14 calendar days to pay. If payment is still not made, statutory interest and the fixed compensation under Book XIX of the Belgian Code of Economic Law are charged.
5. Performance of the assignment and changes
5.1 Artisu Interieur carries out assignments to the best of its ability (obligation of means) and in line with the client's specific wishes.
5.2 If the client has additional wishes or changes during the design process that fall outside the original quote (extra work), the extra hours or costs are communicated in advance and invoiced separately.
6. Cancellation and right of withdrawal
6.1 Right of withdrawal: if the agreement is concluded at a distance (for example by email or through the website) or outside the studio, the consumer has a withdrawal period of 14 days. If the client expressly asks for work to start within that period and then withdraws, they pay an amount in proportion to what has already been done. If the service has been fully performed within the period at the client's express request, and the client has acknowledged that they then lose the right of withdrawal, the right of withdrawal lapses.
6.2 Cancelling appointments: scheduled appointments on site or in the studio must be cancelled at least 24 hours in advance. For cancellations within 24 hours, the reserved time may be charged. If Artisu Interieur has to cancel an appointment within 24 hours due to force majeure, the client is entitled to a free rescheduling or an equivalent arrangement.
7. Intellectual property
7.1 All designs, sketches, 3D visualisations, plans and mood boards by Artisu Interieur remain its intellectual property.
7.2 The client obtains the right to use them for carrying out the project in their own home once all invoices have been paid in full. The client may not sell, copy or share the designs with third parties for other projects without permission.
7.3 Artisu Interieur may use photos or designs of the completed interior anonymously for its portfolio, website or social media, unless the client expressly objects in advance.
8. Liability
8.1 Artisu Interieur is only liable for direct damage that is the direct result of a proven serious fault or intent on the part of the interior architect.
8.2 Liability is in all cases limited to the amount invoiced and paid for the assignment concerned.
8.3 Artisu Interieur is not liable for errors or defects of external contractors (such as builders, painters or joiners), even if Artisu Interieur has taken on the coordination or aesthetic supervision. The agreement for the construction or renovation is directly between the client and the contractors carrying out the work.
8.4 These limitations do not apply in the event of death or personal injury, nor to the extent that the law prohibits a limitation of liability.
9. Privacy
How Artisu Interieur handles personal data is explained in the privacy policy.
10. Applicable law and disputes
10.1 All legal relationships between Artisu Interieur and the client are governed exclusively by Belgian law.
10.2 In the event of a dispute, the parties first try to reach an amicable solution together. The consumer can also contact the Belgian Consumer Mediation Service free of charge. If no solution is found, the courts of the judicial district of Limburg have jurisdiction, without prejudice to the consumer's right to choose the court of their place of residence.
